
In a unanimous ruling on April 25, 2025, New York’s Appellate Division, Fourth Department, overturned a SUNY Buffalo State University disciplinary finding against our client. The Fourth Department found no substantial evidence existed to support the allegations of non-consensual sexual contact, and it therefore annulled the decision. It also ordered the school to completely expunge our client’s record.
This decision reinforces that campus disciplinary proceedings must be based on evidence, not speculation. Even when facing challenging accusations, students deserve proper due-process protections. Our firm remains committed to defending students’ rights in campus disciplinary matters.
