The case, filed in federal court against Starpoint Central School District, centers on whether schools can reject medical exemptions that have been approved by a physician. Davenport argued that the school’s denial of a valid, physician-approved medical exemption violates the First Amendment and 14th Amendment rights of the student’s parents, who filed the case, as it infringes on their right to make decisions for their own children.

Davenport secured a preliminary injunction which allowed the student to return to her school while the case moves forward, so the student can continue her education without disruption.
