Overview

Preserving land requires more than intent. It requires legal structure that protects it long-term. Rupp Pfalzgraf’s Land Conservation team represents land trusts, private landowners, nonprofits, and conservation organizations working to preserve open space, farmland, forests, wetlands, and environmentally significant property across New York State.

We focus on the legal mechanisms that make conservation possible by structuring, securing, and enforcing land protection strategies that hold up over time.

Land conservation has become increasingly complex as development pressure intensifies and landscapes become more fragmented. Traditional approaches are no longer enough. Conservation efforts now require sophisticated legal planning, strong partnerships, and enforceable structures that can withstand both legal and economic pressure.

Our attorneys work closely with land trusts, conservation organizations, and private landowners to structure and implement long-term land preservation strategies. This includes drafting and negotiating conservation easements, facilitating land acquisitions and transfers, and supporting the operational needs of land trust organizations.

We do not just help preserve land on paper. We ensure that those protections are enforceable. Our team provides litigation support to enforce conservation easements, defend protected land, and resolve disputes involving property rights and conservation restrictions.

In addition to preservation strategies, we handle the transactional side of conservation work, including title review, environmental due diligence, easement structuring, and real estate closings.
